What Should You Pay Attention to Before Signing an Employment Contract?

Starting a new job is an exciting process, but it also requires care. In the excitement of being accepted for a job, some employees may sign the employment contract presented to them without reviewing it carefully enough.

However, an employment contract forms the basis of the working relationship between an employee and an employer. Therefore, reviewing certain important points before signing may help prevent disputes that could arise in the future.

1. Check the Salary and Payment Terms

Be sure to check the amount of pay stated in the employment contract and whether it is expressed as a net or gross amount.

Also obtain clear information about when the salary will be paid and whether there are additional forms of compensation, such as bonuses or performance payments.

2. Find Out About Working Hours

Matters such as weekly working hours, daily working hours, shift arrangements, and weekly rest days directly affect your working life.

For this reason, it is important to find out what your work schedule will be before starting the job.

Under Labor Law No. 4857, the general weekly working time may not exceed 45 hours. Work exceeding this period is considered overtime subject to the conditions specified by law.

3. Pay Attention to the Probationary Period

A probationary period may be agreed upon in employment contracts.

Under Labor Law No. 4857, the probationary period may generally be no longer than two months. This period may be extended to up to four months through collective bargaining agreements.

During the probationary period, either party may terminate the employment contract without observing the notice period and without paying compensation. However, the employee retains their right to wages and other entitlements for the days worked.

4. Review Your Duties and Responsibilities

It is important for the job description of the position you are hired for to be clear.

Finding out in advance what tasks you will perform, who you will report to, and what responsibilities you will assume may help reduce disputes about job duties in the future.

5. Find Out About Leave and Fringe Benefits

Annual paid leave, weekly rest days, national and public holidays, and fringe benefits such as meals, transportation, and private health insurance are important parts of working conditions.

Find out which of these benefits are offered and under what conditions they may be used.

6. Obtain a Copy of the Contract

Be sure to keep a copy of the employment contract after signing it.

Having a copy of the contract will make it easier to protect your rights if a dispute concerning your working conditions arises in the future.

Conclusion

An employment contract is not merely a document signed to start a job. It also determines a significant part of the rights and obligations you will have throughout your working life.

Therefore, not signing the contract without reading it, asking for clarification about any provisions you do not understand, and clarifying the working conditions in advance are the first steps toward a healthy employment relationship.
