USER AGREEMENT
This User Agreement (“Agreement”) is applicable to all users
who benefit from the services provided through the website and digital
platforms operated by Human Kapital Human Resources and Consultancy Services
Industry and Trade Limited Company (“Human Kapital”). Anyone who becomes a
member of the site, submits an application, or benefits from the services in
any manner shall be deemed to have accepted this agreement.
1. Parties
This agreement is executed between Human Kapital Human
Resources and Consultancy Services Ind. Trade Ltd. Co.
Address: Kazımiye Mah. Narçiçeği Sok. Doğan Apt. No:22 Floor:1 Apt:5 Çorlu /
Tekirdağ and real persons (“User”) who access the site, become members, submit
applications, or benefit from the services.
2. Subject
The subject of this agreement is the determination of the
terms of benefiting from recruitment, candidate referral, career consultancy,
and similar services provided by Human Kapital, as well as the rights and
obligations of the parties.
3. Scope of the Service
Human Kapital;
- Enables candidates to apply for job postings,
- Directs candidates to suitable positions,
- Presents candidate profiles to clients,
- Acts as an intermediary in recruitment processes.
Human Kapital does not guarantee the placement of the candidate; it only provides intermediary and consultancy services.
4. Obligations of the User
The User is obliged to;
- Provide accurate and up-to-date information,
- Not provide misleading, incomplete, or false information,
- Not violate the rights of third parties,
- Not misuse the system,
- Not carry out actions contrary to law and morality.
All responsibility arising from incorrect or incomplete information provided by the user belongs to the user.
5. Account Security
The User is obliged to keep account information
confidential.
Transactions carried out through the user’s account shall be deemed to have
been performed by the user, unless proven otherwise.
6. Intellectual Property Rights
All content, design, software, text, logos, and visuals on
the website belong to Human Kapital.
They may not be copied, reproduced, or distributed without permission.
7. Modification and Suspension of the Service
Human Kapital may unilaterally change the content and scope
of the services, or temporarily or permanently suspend them. The user is not
required to be separately notified of this situation.
8. Limitation of Liability
Human Kapital;
- Does not guarantee that the user will be placed in a job,
- Cannot be held responsible for client decisions,
- Is not responsible for damages arising from technical failures, internet interruptions, or force majeure events.
9. Protection of Personal Data
Personal data belonging to the user is processed within the
scope of the KVKK and relevant legislation. Details are included in the KVKK
Information Notice.
10. Termination of the Agreement
Human Kapital may suspend or terminate the membership if the
user acts in breach of the agreement. The user may also close their account at
any time.
11. Amendments
Human Kapital may unilaterally update this agreement. The
updated text shall enter into force as of the moment it is published on the
website.
12. Applicable Law and Jurisdiction
Turkish Law shall apply to this agreement.
Tekirdağ (Çorlu) Courts and Enforcement Offices shall have jurisdiction over
any disputes that may arise.
13. Entry into Force
By becoming a member of the site, submitting an application,
or benefiting from the services, the user declares that they have read,
understood, and accepted all provisions of this agreement.
